Claims Against Police

Claims against the police (or actions against the police, as they are sometimes called) are civil claims, primarily based in the law of delict. They include but are not limited to unlawful arrest claims and unlawful detention claims. Such claims are characterised by the conduct of police officers when they exceed their authority in executing an arrest or when a person’s freedom of movement is unjustifiably restricted by an officer of the law.
